Son of Packers coach charged with sexual assault

GREEN BAY (AP) - An 18-year-old Green Bay man who is the son of Packers offensive coordinator Joe Philbin was charged Thursday with sexual assault and battery.

Michael T. Philbin pleaded not guilty in his initial appearance. He faces two counts of having sex with a child over the age of 16 and two counts of battery - all misdemeanors. Each count carries a maximum fine of $10,000 and nine months in jail, if convicted.

Philbin's lawyer did not immediately return a call or e-mail seeking comment.

The court clerk's office said a pretrial hearing is scheduled for March 13.

The criminal complaint alleges Philbin had nonconsensual sex with two females who said they were drunk at his Brown County home the night of Aug. 21.

The state Department of Justice is prosecuting the case following an investigation by the Green Bay Police Department.

I've been hearing more of these types of things lately. Much goes unreported. HGH, youporn and redbull & jager makes a bad combination I think.

You have a year in Illinois I think to turn a guy in. This happens, they collect evidence, some weeks later the girl comes to grips with what happens and files a complaint.

The info that he was 17 at the time of the alleged incident was in Bedard's blog. Not sure the prosecutor released that information.

It was on the local GB news tonight there were 2 criminal complaints.

One girl said she was held down by another male teen after she said no to Philbin's request for a sex act. When she was held down Philbin had sex with her.

2nd girl was taken to the master bedroom and passed out. When she came to, Philbin was having sex with her.

Nothing was stated about the other male teen involved in this.

He and a friend took advantage of two young ladies who were too drunk to even know what was going on...including having sex with one that was passed out and "alleged that after Philbin helped her to the bed in the master bedroom, he undressed her and “performed an act of sexual intercourse on her without her consent.”"

These ladies hardly cooperated...unless you count being passed out as cooperative.

All I know is, if this goes badly for Philbin's kid, it opens up another whole mess for Joe Philbin.... meaning a lawsuit.

If the kid was underage at the time of the alleged assault, then the parents are legally responsible. I'm just saying that if my kids had a beer party at my house and something illegal happened or some harm took place to one of the people in the party, it's my butt that would be in a sling. If he was 18, it would be the "kid's" since he is legally an adult.

Sexual assault is all too prevalent...unfortunately, false accusations, in the long run, end up harming those who were truly assaulted.

FYI, the charges will amount to 3 years in prison if the max. is applied (if he is found guilty on all counts - 2 counts of battery, 2 counts of nonconsensual sex).

Regardless if these are true or false accusations, the levity attached to rape in this thread is pretty disgusting. I would attach false accusations of rape at the same level of the act of rape itself.

I think the prosecutor is being "badge heavy". The preliminary facts would indicate gross sexual imposition or similar charges. I'm not saying this kid was an innocent lamb, but this case seems less than rape by the intial stating of the facts.

I am judging neither the accused nor the reported victims in this situation, there is simply too much left unknown at this point. However, some random thoughts:

- Every parent's nightmare when leaving your nearly adult child alone for the weekend.
- Let's not automatically assume that the facts alleged in the complaint are true.
- OTOH, there are teenage males out there with screwed up views on sex.
- This wouldn't be the first time teenage males have forced themselves on someone.
- This would not be the first time a remorseful but willing girl tried to blame the guy.
- Finally, whoever is really at fault here has damaged the other for life. If the guys did what is alleged, there is no excuse for it. If the girls are falsely accusing the guys because they regret their willing participation, they will have branded these boys for life.

Whichever way it is, it is a truly regrettable situation.

Perhaps we all should wait for the facts before we judge. You have criticized Mad for simply questioning what happened, yet you are willing to condemn these boys when the full story is not known. Only one version has been given. How do you know what the real facts are? Are the things you identified as facts really facts just because they appear in a criminal complaint? There are literally hundreds of subsequently exonerated convicts who will disagree with that.

That is why we have trials, and why both sides are allowed to present their witnesses and testimony. Sometimes prosecutors have it completely wrong. More often I believe they have it right, or at least close to right, but not always. Sometimes prosecutors get carried away going after someone famous or semi-famous in an attempt to show they are fair and not giving "breaks" to anyone. Sometimes the famous and semi-famous think they can and should get away with things others do not.

There are many sides to be heard. Let's wait to hear them while acknowledging that whoever is the wrong-doer deserves to be punished.

Well, alright then. If you're pissed that people seem to be judging the young guy before anybody really knows, I'm with you. But the way I read your post, that wasn't what you were on about. You go back and read those posts, you mad man, and I think you'll see that it looks like you're defending the idea of getting it on with a passed out woman.

So there you have it.......things may have not gone down exactly as alleged in the complaint, but it was definitely enough evidence for the boy to not take a chance on a trial and take a plea.

Maybe he took the plea to avoid being labeled a sex offender for life had he lost in trial?

Doesn't matter....if he doesn't change his ways (seriously) it will catch up with him at some point.

When this thread was started, I thought they were gonna bring felony rape charges on the kid. They charged him with misdemeanor sex charges which are about right. The kid did wrong and he will cop to the appropriate punishment. The boy needs help, fer sure.

The two females weren't innocent little lambs, but the boys took advantage big time.

I think the thing worked out in the long run.
