Suspicion of DUI.

This is the third issue in the last several months for Smith: the shooting charge, another DUI that was reduced to reckless driving, and now this.

You have to think Goodell is going to get involved soon.

49ers are saying they will not suspend him and the League will have to act. I hope the League acts to stick a 2x4 into Harbaugh.

He blew a .15 at 7am on the last practice day before a game during a week following an asswhoopin. I don't see a problem here.

Vernon Davis could have chosen a better idiom. It seems like this horse has no problem with drinking.

Saw in another article that he was passed out at the wheel with his foot still on the gas, and there was marijuana in the car.

My guess? Harbaugh knows he's going to be suspended for a while, SF will probably release him, and he and wants to get one more game out of Aldon before the hammer comes down.


Cam Inman of the San Jose Mercury News reports that Smith was found with more than just alcohol when arrested:

No one was hurt in Friday’s 7:00 a.m. incident in the Silver Creek area, Sgt. Heather Randol said. It was not immediately clear if Smith was booked and released, posted bail or remains in custody.

Marijuana and pills also were found in the car, sources said.

I'd be surprised if they released him. They may seek a trade before his rap sheet gets too long. There's been a lot of discussion around here lately about whether the Broncos should try to unload Von Miller for some picks before he torpedoes his stock.

thats a lot of rubber there. he was definitely there for awhile with his foot on the gas

how the hell did he hit the tree in that direction? was he at that house pointed nose out and just drove straight into the tree?

i don't get how they suspend some guys for life before the legal process happens while clear cut things like this they let go

guy is a multiple offender, not only should he be locked up, but he should be suspended for at least a year

jolly got 3 years and i believe that happened before he went to court

I thought Jolly got suspendered before the legal process completed also.

His trial kept getting delayed. I think it was due to go to trial in August and he was suspended in July. I think they just decided to suspend him until his legal situation was clarified. The Packers had sent him home anyway, so the suspension didn't matter much.
