    Therapist Pleads Guilty to Molesting Brain-Damaged Patients

    Wayne Albert Bleyle Admitted to Eight Counts of Forcible Lewd Acts Upon a Child and Four Counts of Exhibiting a Minor in Pornography.

    San Diego -- June 12, 2007—

    A former respiratory therapist pleaded guilty Tuesday to molesting young, brain-damaged patients at the hospital where he worked for 25 years.

    Wayne Albert Bleyle, 55, admitted to eight counts of forcible lewd acts upon a child and four counts of exhibiting a minor in pornography.

    Under a plea agreement, Bleyle would serve 45 years and eight months in prison. With credit for good behavior, he would serve at least 85 percent of that sentence. He had faced a sentence of up to 165 years if he had been convicted in a trial.

    Bleyle, who worked at Rady Children's Hospital in San Diego, appeared gaunt and pallid in a loose-fitting navy suit. He answered procedural questions in a firm, quiet voice.

    Bleyle admitted abusing four of his patients, including a 2-year-old girl. Two of the children have since died, according to prosecutors.

    Superior Court Judge Kenneth So denied bail and scheduled sentencing for July 25.

    Bleyle was arrested in March 2006 after Immigration and Customs Enforcement agents traced child porn Internet traffic to his home computer in suburban Santee. Prosecutor Laura Gunn told a judge then that Bleyle targeted children who were "the most brain-damaged, most comatose, most nonverbal - children who could never say anything about it."

    Bleyle confessed to federal agents that he molested "countless" disabled patients, the prosecutor told the court last year.

    "One of the agents who interviewed him said, 'How many kids are we talking about?"' Gunn said. "The defendant, who was in New York at the time looking out at the snow, looked out at the snow and said, 'How many snowflakes are there out there?"'

    Prosecutors accepted the plea in part to spare one girl, a teenage stroke victim, from testifying before a jury, Gunn said. The girl said in preliminary hearings last year that Bleyle touched her buttocks three years ago while she was in a convalescent ward.

    "This is absolutely one of the worst child molestation situations imaginable," Gunn told reporters outside the courtroom. Bleyle's attorney, Casey Donovan, declined to comment after the hearing.

    Bleyle worked at the well-regarded hospital for 25 years, including 10 at the convalescent facility. Former colleagues have described him as an engaging, hardworking therapist who volunteered for extra shifts, reassured parents and served as a mentor to new hires.

    Affidavits filed in support of search warrants indicate that investigators found images on Bleyle's computer and cell phone that he had created himself using children at the hospital. His arrest prompted the hospital to ban camera phones in the convalescent unit and require that curtains around patients be left open most of the time.

    Barely a month after Bleyle's arrest, another hospital employee was charged with molesting a comatose toddler patient after being traced through Internet file-sharing networks. Christopher Alan Irvin, a 32-year-old nurse at the time, pleaded guilty in September and was sentenced to 14 years and eight months in prison.

      Government can protect the public be removing these predators from society, but how do you punish them commensurate to their crimes?

      Forget rehabilitation. Go straight to the punishment.

      Seriously, would death be too harsh as a punishment for those who victimize the most vunerable among us?

      Society is so sex-crazed as it is. You can get your jollys with anything on two or four legs these days. But when does society draw a line and send a message to perverts that if you victimize two-year olds, toddlers, and the comatose then society will ensure that you will have Hell to pay?

      Forget the free speech and privacy BS. The most "progressive" among us are usually the worst offenders.

      The complaint states that federal investigations into child pornography websites revealed that "Charles Rust-Tierney has subscribed to multiple child pornography website over a period of years."

      As recently as last October, the complaint alleges, "Rust-Tierney purchased access to a group of hardcore commercial child pornography websites."

      Rust-Tierney admitted to investigators that he had downloaded videos and images from child pornography websites onto CD-ROMs, according to the complaint.

      The videos described in the complaint depict graphic forcible intercourse with prepubescent females. One of the girls is described in court documents as being "seen and heard crying", another is described as being "bound by rope."

      Rust Tierney coaches various youth sports teams in and around Arlington, Virginia, according to court documents.

      In the past, Rust-Tierney had argued to allow unrestricted Internet access, including pornography, in public libraries in Virginia, writing, "Recognizing that individuals will continue to behave responsibly and appropriately while in the library, the default should be maximum, unrestricted access to the valuable resources of the Internet."

      On June 1, 2007, he pleaded guilty to one count of receipt of child pornography. His sentencing is scheduled for Sept. 7, 2007. He could face up to 20 years in prison, but his attorneys and prosecutors have agreed to recommend a sentence of 8 to 10 years.

        There are some real sick bastards in this world. However, we cannot kill them. I don't think they choose to be in the world of child pornography. I think there is just something wrong with them that they have a compulsion to view the kiddie porn.

        Nonetheless, people like this should be locked away for a good amount of time.

            BH you talk a lot of big talk about how drug addicts should go to the slammer when they are only hurting themselves most of the time. Yet these kinda scumbags do unrepairable damage that these kids will never forget and might even turn them into a sexual predator and you think they deserve any mercy??

            Kill them and kill them all because if I ever found out someone was doing something like this to someone I care about that is exactly what I will do. Then I get to go to prison for life or get the death sentence.

            That's justice for your ass.

              Mad, do you think these pedophiles choose to be sick? Do you think they choose to delve into a matter which is not only morally wrong, but illegal? It is a sick compulsion that is brought on by childhood trauma or just a twisted compulsion.

              Doing drugs is a choice. Most people that are born don't have a compulsion to do drugs. They choose to do drugs. Whether it be peer pressure or poverty, it is their choice.

              You have to be mentally twisted to look at a toddler being tied up by a rope. There's no way you can tell me that's "normal behavior."

              I am not condoning these lewd and sickening acts, but I am simply stating that you cannot place all the fault on their side. It is no different then being gay. People don't choose to be gay. Why would you choose to be exiled and ostracized by society?

                It doesn't matter WHY pedophiles do what they do. The fact is they do it. You can't compare it to being gay, because gay people are dealing with other consenting gay people, not little kids. This is a crime because it has a victim. Are you going to tell the victim that the perpetrator is just sick in the head? Once someone does something like this they need to be stopped. I'm all for castration (though the lobotomy was a nice option as well).

                  BH, can't the same logic be used then in all heinous crimes? Who in their right mind commits rape, murders, or even arson?
                  No, a line needs to be drawn. Any crime involving a victim, regardless of age, needs to have serious consequences.


                  Please, don't compare being gay, to anything we're talking about here. Whether it's a choice, genetics, whatever, it's between consenting adults. The key word here being 'consenting'.

                    Just to establish something.

                    In my post I was referring to guys that are involved in child pornography.

                    However, I believe there should be 0 tolerance for perpetrators that go the extra step and physically molest a child. That is disgusting and punishment should be severe and swift.

                      But the ones involved in child pornography are the ones creating the market for the pornographers. If you're willing to look at the pictures, they have to come from somewhere...

                          People do the sickest shit to get their rocks off. I got no problem with kink but it had better be between two adults who consent to do unto one another not some kid in a hospital bed.

                            I feel the same way, and up until Lords of the Rings, I would have wholeheartedly agreed.

                            Today,I no longer support the death penalty. Society is judged by it's justice systms. Only God can create life, only God should be able to decide who lives and who dies. That's my philosophy.

                            But, we have a first obligation to protect the "weakest" members of our society, starting with our children (our future) and our pensioners (our past).

                            Predators must be removed from society. My ideal solution was portrayed in that film starring Kurt Russell (Escape from NY) where Manhatten had been turned into a Jail and the inmates had to fend for themselves. No escape. Mo mercy. No Parole. No "therapy". No visitation rights. No contact with the outside world. The End.

                              The good folks of Manhattan might not like handing over their pricey digs so it can be turned into a 'Jail'.
