  • Steve McNair arrested

    NASHVILLE (AP) — Baltimore Ravens quarterback Steve McNair was arrested early Thursday and charged with being the owner of a vehicle operated by a drunken driver.

    The former Tennessee Titans player was a passenger in his silver pickup, police said.

    He was arrested under a misdemeanor statute that charges the owner if an intoxicated person is allowed to drive a vehicle.

    The driver was stopped because the truck was speeding, police said.

    McNair was arrested in downtown Nashville in May 2003 and charged with DUI and illegal gun possession.

    After a year of legal wrangling, a judge dismissed those charges, ruling that police didn't have sufficient reason to pull over McNair in the first place.

    Does this law apply in all states? Or just TN?

      I don't know. I think this is going too far. If the owner of the vehicle isn't driving, he probably is drunk. I think taking the step that you won't drive is a good decision. Obviously, your abilities to read whether another person is drunk is probably impaired. I think it's kind of petty. It's up to the other individual to determine if they are also too drunk to drive. I think the cops down there are just trying to get him back for getting out a DUI 5 years ago--when a judge ruled that the cops didn't have a legitimate reason for pulling him over.

          I don't agree. I think each individual should take the responsibility of determining whether they are drunk. It seems kind of strange to make a law that requires somebody that is likely more drunk of the two to determine if the other guy is too drunk to drive. I'm sure the driver of the vehicle will get charged for DUI, and get raked over the coals. That seems like a fair result.

            Even with giving McNair the benefit of doubt, this was still a stupid move on his part.

            Call a cab, for heaven's sake!!!! Not like he can't afford it.

              True. Even though this is a law I've never heard of, and much as I wouldn't want to be driving drunk, I don't think I'd want anyone else driving my car drunk either. Expecially with me in it.

                This seems to be going overboard to me. It shows that he likely learned from a past mistake, and didn't want to drive. You can't tell me nobody has gone out with some buddies and given up their keys to their car because they wanted to drink more. Then, you likely get pretty sloshed. How do you have the ability to read how drunk your the "sober" driver got. Now, for making the decision that you aren't going to drive--two people get charged with a car instead of one. Doesn't seem fair to me. Shows me how individual rights keep getting infringed in this country, and individual responsibility is being lost.

                    I'm with Harvey, this is probably one of the dumbest laws I've heard of in a long time. Is it even constitutional?

                        Well, McNair's got the money to challenge it...
                        It's like charging parents for their kids crimes. MAYBE you were a bad parent....but maybe the kid is just a bad apple. How can you be 100% sure enough to charge someone?

                          I think the idea is to deter drinking and driving at any cost. There's really no excuse for it. Dont drive after drinking. I realize it wasnt Mc Nair, but he could have said no one is driving my car after drinking.

                            Yea, at any cost. Like the supreme court ruling that they can have checkpoints where they check everyone regardless of probable cause. That's real American. Some third world countries give the individual more rights than that.

                            If you can stop me without probable cause at a DWI checkpoint, why stop there? Run a check for warrents, search my car. Make sure I am a legal resident. Just think of all the bad things you could fix if the authorities could stop you for NO REASON other than to verify you are not up to evil things.....


                            The supreme court that upheld that were hypocritical idiots who should have been removed immeditaely for violating their office.
