Wisconsin Court Tosses Sexual Assault Charges Against Accused Grave Robbers

Three men who dug up a young woman's corpse to have sex with it after seeing her obituary photo cannot be charged with attempted sexual assault because Wisconsin has no law against necrophilia, an appeals court ruled Thursday.
A judge was correct to dismiss the charges against twin brothers Nicholas and Alexander Grunke and Dustin Radke, all 21, because lawmakers never intended to criminalize sex with a corpse, the District 4 Court of Appeals said in a 3-0 ruling.
The three men went to a cemetery in Cassville in southwestern Wisconsin on Sept. 2 to remove the body of Laura Tennessen, 20, who had been killed the week before in a motorcycle crash.
The men used shovels to reach her grave. They abandoned their plan and were eventually arrested after a vehicle drove into the cemetery and reported suspicious behavior, authorities said.
They said the men had seen an obituary of Tennessen with her photo and wanted to dig up her body to have sexual intercourse. Such an act is known as necrophilia.
The men were charged with attempted third-degree sexual assault and misdemeanor attempted theft charges. But Grant County Circuit Judge George Curry dismissed the sexual assault charges in September, saying no Wisconsin law addressed necrophilia. Prosecutors appealed his ruling.
At issue is a provision in the sexual assault law saying criminal penalties apply "whether a victim is dead or alive at the time of the sexual contact or sexual intercourse."
The appeals court said the law was ambiguous but the most reasonable interpretation was that it does not ban necrophilia. Instead, the court said, the law was meant to make sure prosecutors could bring sexual assault charges in rape-murder cases in which the victim ends up dead.
Outrage over the case might soon change the law.
Sen. Dale Schultz, R-Richland Center, introduced legislation Wednesday that would make having sex with a corpse a felony with punishment of up to 6 years in prison and a $10,000 fine. The bill would levy the same penalties against anyone who intentionally disturbs a burial site or a buried human corpse.
We didn't know we needed a law! Now, I guess we do.

One man, two OWIs in two hours

NORWAY — A Franklin man’s plea to "just give me a ride home" instead landed him to the Racine County Jail after he was booked twice in just over two hours for drunken driving.
Clayton J. Paul’s bad day started July 23 when he tried to leave a bar parking lot at 2:17 p.m. and backed his truck into a Racine County Sheriff’s Department cruiser at a high rate of speed, authorities said.
The impact left a large dent in the squad car’s front bumper and Paul’s blood-alcohol level registered a 0.16 — twice the legal limit of 0.08.
Paul, 53, was cited for operating a vehicle while intoxicated and exceeding the legal limit. He was booked at the Town of Waterford police station and released to the custody of his wife.
Twelve minutes later at 4:38 p.m., a deputy pulled Paul over again.
According to records, the deputy said that Paul told him, "just give me a ride home."
Instead, Paul failed sobriety tests and registered a 0.13 blood-alcohol level.
He received citations again for OWI and exceeding the legal limit. After being taken back to the station, he was transferred to the Racine County Jail.

a buddy told me while he and a friend were in sturgis for the bike rally he was pulled over for DWI, but the jail was full so they released him and dropped him off on the highway. as he was walking he came upon a tractor and decided it would be quicker it drive the tractor than walk. well same cop sees him driving the tractor and needless to say they make room for him in the jail the second time.

32,000 Quarters Leak Onto Wis. Roads

MADISON, Wis. (AP) - Imagine the ringing noise of 32,000 quarters hitting the pavement.
An armored car company reported losing $8,000 in quarters along highways in two Wisconsin counties last month. About half has been returned.
"I guess somebody found that and figured it was an early Christmas," Jefferson County Detective Sgt. Lawrence Lee said.
Eight-hundred dollars of loose quarters was found late last month in the Madison area and $3,200 in Jefferson County the next day.
Loomis Fargo officials told authorities that a truck headed for Madison carrying boxes of quarters broke down in the Pewaukee area, so they sent another one. The load was transferred, but someone forgot to secure the door.
The driver was issued a citation for failure to prevent a leaking load.

ok, this isn't really national news, but the one line in here caught my eye... this is from todays Milwaukee Journal......
Free water park admission today
There will be free admission to Pelican Cove water park tonight as part of National Night Out on Milwaukee's south side.
The event will be held from 4 to 8 p.m. at Kosciuszko Park, 2201 S. 7th St.
The Milwaukee Police Department dive team will give a presentation and the the Milwaukee County Sheriff's Office bomb squad, K-9 unit, mounted patrol and bike units will also be present.
The movie "El Clown" will be shown at dusk with subtitles in English.
The event is sponsored by the sheriff's office, Milwaukee Police Department, the South Side National Night Out Committee and Milwaukee County Supervisor Peggy West.

I thought the north side was even worse for crime? Then again, other than going to visit my nephew at Marquette, an occassional concert at the Bradley or misc things downtown, I'm not too familiar with Milwaukee these days.Originally posted by PartialThe only thing I ever go into the barrio for is the Pick'n'save that is just across the bridge on 26th. . The north side definitely is not anywhere I would want to be driving around at night, either. Ideally, I try to stay in the hales corners/greendale area as much as possible.

Madison police capture wanted monkey
MADISON, Wis. (AP) — Authorities captured a diaper-wearing monkey who led them on a downtown search after biting a woman.
The 20-year-old woman reported being bitten on the thumb as she tried to pet the animal early Wednesday.
The woman was walking by State Street Brats, a popular nightclub, where a man had the monkey on a leash inside its beer garden. People walking by were petting the monkey, who was wearing a white diaper.
But the monkey bit the woman, who suffered four small punctures on her thumb, police said.
The bite sent the woman to the hospital, where a physician said the monkey should be found so that it could be quarantined to determine if it has a disease.
By 7:15 a.m., police found the man and the monkey. But the man lost the handle on the monkey before an animal control officer arrived and it got loose.
Police issued a warning to the public of the foot-tall monkey with a long prehensile tail: "It is now on the lam, presumably still in the State Street area."
About seven hours later, the monkey was captured and taken into custody downtown to be quarantined for 10 days, police said.
